The statute of limitations may not run until two years after they are considered an adult.\u00a0 The problem with waiting this long is that may be difficult to obtain records or solicit relevant witness testimony.\u00a0 In addition, a long delay could make investigation difficult, if not impossible.Birth Injuries: If there is an allegation that a child was injured at birth, there are different time restrictions than stated above. Some birth injuries are a result of medical malpractice.\u00a0 The statute of limitations for children born before July 2004 asserting this type of claim is their twentieth birthday.\u00a0 Those born after July 2004 only have until their thirteenth birthday.Claims against Public Entities: A claim against a public entity must be made within 90 days of the child\u2019s eighteenth birthday, unless it a medical malpractice matter.
